Our Story
We were a two-man operation: a graphic artist and a web developer. Everyone said that for the sites we wanted to create, we really needed to get our own server and spend the time to manage it. But to us, that was as crazy as saying that to sell t-shirts online, we had to spend our time driving a Mack truck doing the deliveries. There had to be a better way to host our projects. Right?
ETHICS
We have some super-sensitive information on our systems and we take that responsibility seriously. Providing secure servers and a secure physical environment is the least we can do to help protect our clients data. We try to help customers ensure that they have secure passwords on their accounts and of course, we monitor our systems constantly in case of any unlikely malicious attack.
Company Policies
At Lis Hosting we pay close attention to the latest developments in Internet Law and make sure that all of our operations run in concordance with those laws. Please peruse these documents, and if you have any questions don't hesitate to contact us.
Acceptable Use Policy
As a provider of web site hosting, and other Internet-related services, Lis Hosting offers its customers (also known as subscribers), and their customers and users, the means to acquire and disseminate a wealth of public, private, commercial, and non-commercial information. Lis Hosting respects that the Internet provides a forum for free and open discussion and dissemination of information, however, when there are competing interests at issue, Lis Hosting reserves the right to take certain preventative or corrective actions. In order to protect these competing interests, Lis Hosting has developed an Acceptable Use Policy ("AUP"), which supplements and explains certain terms of each customer's respective service agreement and is intended as a guide to the customer's rights and obligations when utilizing Lis Hosting's services. This AUP will be revised from time to time. A customer's use of Lis Hosting's services after changes to the AUP are posted on Lis Hosting's web site, www.Lishosting.com.au, will constitute the customer's acceptance of any new or additional terms of the AUP that result from those changes.
One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use the Internet, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that Lis Hosting cannot monitor, verify, warrant, or vouch for the accuracy and quality of the information that subscribers may acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet is sexually explicit or otherwise offensive. Because Lis Hosting cannot monitor or censor the Internet, and will not attempt to do so, Lis Hosting cannot accept any responsibility for injury to its subscribers that results from inaccurate, unsuitable, offensive, or illegal Internet communications.
When subscribers disseminate information through the Internet, they also must keep in mind that Lis Hosting does not review, edit, censor, or take responsibility for any information its subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation, and other harmful speech. Also, because the information they create is carried over Lis Hosting's network and may reach a large number of people, including both subscribers and nonsubscribers of Lis Hosting, subscribers' postings to the Internet may affect other subscribers and may harm Lis Hosting's goodwill, business reputation, and operations. For these reasons, subscribers violate Lis Hosting policy and the service agreement when they, their customers, affiliates, or subsidiaries engage in the following prohibited activities:
Spamming -- Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming"). It is not only harmful because of its negative impact on consumer attitudes toward Lis Hosting, but also because it can overload Lis Hosting's network and disrupt service to Lis Hosting subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, Lis Hosting has the discretion to determine from all of the evidence whether the email recipients were from an "opt-in" email list.
Adult Material -- Because the Internet is a global communication tool it is difficult to dictate what is considered "adult material." However, it is not our function to discriminate against those who choose to utilize adult content or adult related material. This being said, there are still several reasons why Lis Hosting has been forced to create its no adult sites policy for its virtual server users.
What does Lis Hosting consider "Adult Material?"
Any site whose revenue is gained in part or whole from its adult content.
Photos or videos showing frontal nudity on either men or women for non-scientific or non-artistic purposes.
Revenue-generating hyperlinks to sites who violate policy #1.
Intellectual Property Violations -- Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. Also, engaging in activity that violates privacy, publicity, or other personal rights of others. Lis Hosting is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringement. It is also Lis Hosting's policy to terminate the privileges of customers who commit repeat violations of copyright laws.
Obscene Speech or Materials -- Using Lis Hosting's network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material. Lis Hosting is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through Lis Hosting's network.
Background Running Programs -- Background Daemons in general are prohibited on Lis Hosting servers, including, but not limited to, IRC bots, eggdrop, BitchX, XiRCON, warez sites and any other program that interferes with normal server operation. Lis Hosting will be the sole arbitor of what consitutes a violation of the above policy.
Defamatory or Abusive Language -- Using Lis Hosting's network as a means to transmit or post defamatory, harassing, abusive, or threatening language.
Forging of Headers -- Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.
Illegal or Unauthorized Access to Other Computers or Networks -- Accessing illegally or without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).
Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities -- Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mailbombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment.
Facilitating a Violation of this AUP -- Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mailbombing, denial of service attacks, and piracy of software.
Export Control Violations -- Exporting encryption software over the Internet or otherwise, to points outside the United States.
Usenet Groups -- Lis Hosting reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.
Other Illegal Activities -- Engaging in activities that are determined to be illegal, including advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, and pirating software.
Other Activities -- Engaging in activities, whether lawful or unlawful, that Lis Hosting determines to be harmful to its subscribers, operations, reputation, goodwill, or customer relations.
As we have pointed out, the responsibility for avoiding the harmful activities just described rests primarily with the subscriber. Lis Hosting will not, as an ordinary practice, monitor the communications of its subscribers to ensure that they comply with Lis Hosting policy or applicable law. When Lis Hosting becomes aware of harmful activities, however, it may take any action to stop the harmful activity, including but not limited to, removing information, shutting down a web site, implementing screening software designed to block offending transmissions, denying access to the Internet, or take any other action it deems appropriate.
Lis Hosting also is concerned with the privacy of on-line communications and web sites. In general, the Internet is neither more nor less secure than other means of communication, including mail, facsimile, and voice telephone service, all of which can be intercepted and otherwise compromised. As a matter of prudence, however, Lis Hosting urges its subscribers to assume that all of their on-line communications are insecure. Lis Hosting cannot take any responsibility for the security of information transmitted over Lis Hosting's facilities.
Lis Hosting will not intentionally monitor private electronic mail messages sent or received by its subscribers unless required to do so by law, governmental authority, or when public safety is at stake. Lis Hosting may, however, monitor its service electronically to determine that its facilities are operating satisfactorily. Also, Lis Hosting may disclose information, including but not limited to, information concerning a subscriber, a transmission made using our network, or a web site, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation, or governmental request. Lis Hosting assumes no obligation to inform the subscriber that subscriber information has been provided and in some cases may be prohibited by law from giving such notice. Finally, Lis Hosting may disclose subscriber information or information transmitted over its network where necessary to protect Lis Hosting and others from harm, or where such disclosure is necessary to the proper operation of the system.
A subscriber's failure to comply with those laws will violate Lis Hosting policy. Finally, Lis Hosting wishes to emphasize that in signing the service agreement, subscribers indemnify Lis Hosting for any violation of the service agreement, law, or Lis Hosting policy, that results in loss to Lis Hosting or the bringing of any claim against Lis Hosting by any third-party. This means that if Lis Hosting is sued because of a subscriber's or customer of a subscriber's activity, the subscriber will pay any damages awarded against Lis Hosting, plus costs and reasonable attorneys' fees.
We hope this AUP is helpful in clarifying the obligations of Internet users, including Lis Hosting and its subscribers, as responsible members of the Internet. Any complaints about a subscriber's violation of this AUP should be sent to abuse@Lis Hosting.com.au.
Terms and Conditions of Use
This Services Agreement (the "Agreement") contains the complete terms and conditions which govern your subscription of Web hosting, e-Commerce and other Internet-related services provided by Lis Hosting (the "Services"). As used in this Agreement, "Lis Hosting" means Lis Hosting and "Client", "you", or "your" means you. By clicking on the "Submit Order" button, you acknowledge that you have read the Agreement, and you agree to its terms and conditions and all policies posted on the Lis Hosting site. As referred to in this Agreement, "Site" refers to a World Wide Web site and "Lis Hosting Site" refers to the Site located at the URL www.Lis Hosting.com.au, or any other successor Sites owned or maintained by Lis Hosting.
1. APPROPRIATE USE OF THE SERVICES.
Lis Hosting provides the Services exclusively and makes no effort to edit, control, monitor or restrict the content of data other than as necessary to provide such Services.
Client Content.
Client agrees that it will not distribute, electronically transmit or display any materials supplied by Client - or through Client by a third party - to any Lis Hosting server in connection with Client's use of the Services which:
violate any state, federal or foreign laws or regulations;
infringe on any intellectual property rights (e.g., copyright, trademark, patent or other proprietary rights) of Lis Hosting or any third party;
are defamatory, slanderous or trade libelous;
are threatening or harassing;
are discriminatory based on gender, race, age or promotes hate;
violate any Lis Hosting policy posted on the Lis Hosting Site including, but not limited to, our Acceptable Use Policy (includes Adult Content Policy), UCE (SPAM) Policy, and CGI Abuse Policy.
contain viruses or other computer programming defects which result in damage to Lis Hosting or any third party.
Bandwidth.
Client may occupy only the amount of disk space on the Lis Hosting Server and utilize no more than the network bandwidth that is allotted by Lis Hosting. Additional fees, specified on the Plans Comparison page, will be charged for exceeding the disk space and/or network bandwidth allowance of your selected plan.
No "SPAM".
Client shall not use the Services for chain letters, junk mail, spamming, or any use of distribution lists to any person who has not given specific permission to be included in such a process. Client also shall not engage in any unsolicited email practices at Lis Hosting, or otherwise, that mentions or reference any domain hosted on Lis Hosting servers or parked on Lis Hosting DNS servers. NOTE: THIS POLICY APPLIES TO ALL ACCOUNTS, DOMAINS, AND PARKED DOMAINS HOSTED ON THE SERVER. (Violators will be fined! Refer to our UCE (SPAM) Policy).
Licensed Software Only.
Client agrees to use only properly licensed third party software in connection with Client's use of the Services.
Back-Up Files.
Lis Hosting does a back-up of files on the server daily; however, Lis Hosting does not guarantee the existence, accuracy, or regularity of its backup services and, therefore, Client is responsible for making back-up files in connection with its use of the Services. Backup capability is available through the Client’s Control Panel.
Termination.
Lis Hosting reserves the right to refuse service to anyone. Lis Hosting, in its sole discretion, may immediately terminate this Agreement if Client engages in any of the foregoing. To report any unacceptable behavior by a third party using the Services, please contact abuse@lis.com.au.
2. PAYMENT OBLIGATIONS
Service Fees. We send out invoices prior to due invloice dates. All credit cards are billed automatically. It is the clients responsibility to ensure that they have sufficient credit to cover this transaction. In the event that there is insufficient credit, as a courtesy we will send an email notification to the Client notifying them of the situation, after which point we will need to be provided with another credit card within 24 hours. If we do not receive a response within 24 hours the account will be deactivated. Any other accounts found under that account name will be deactivated as well.
If Client terminates this Agreement in accordance with Section 4 hereunder, Client shall be responsible for any outstanding fees owed to Lis Hosting and agrees to pay any and all fees incurred by Client. Because the Services are provided on a yearly basis, unless a contract is in place, Client will be responsible for Service fees incurred each year regardless of when Client provides notice of termination. If Client has retained the Services for one (1) year and has pre-paid Lis Hosting for such Services, refunds will be issued for any unused full month portions less one month of the Services upon Clients request.
Taxes. Customer will be responsible for and will pay in full, any taxes and similar fees now in force or enacted in the future imposed on the transaction and/or the delivery of Services.
Domain Names. If Client chooses to register a domain name(s) through Lis Hosting, Client acknowledges and agrees that Client will pay a registration fee(s) to register the domain name(s) with the applicable domain name registrar. Lis Hosting does not offer refunds for domain name registrations for any reason, including misspelling of the domain name.
3. CLIENT LIABILITY AND INDEMNIFICATION
The parties agree that in no event shall Lis Hosting be liable to any third party for Client's breach or alleged breach of any of the terms and conditions set forth in this Agreement. Client agrees to defend, indemnify and hold harmless Lis Hosting from any and all expenses, losses, liabilities, damages or third party claims resulting from Client's breach or alleged breach of any Client obligations set forth hereunder.
4. TERM, TERMINATION & REINSTATEMENT
Subject to the terms and conditions hereof, this Agreement shall be effective on the date you register for the Services, and shall continue in effect on a month-to-month or year-to-year basis unless otherwise specified by separate agreement (the "Term") unless terminated earlier pursuant to the provisions of this Section 4. Either party will have the right to terminate this Agreement upon notice to the other party. If Client is terminating this Agreement, Client must follow instructions for cancellation provided on the Cancellation Information page of your Personal Account Manager. All cancellations must be sent to sales@Lis Hosting.com.au. There are no cancellation fees for month-to-month contracts. Year-to-Year contracts are subject to a cancellation fee equal to one months payment. You must cancel prior to your next billing cycle. We reserve the right to remove any account without advanced notice for any reason at any time without prior notice.
If Lis Hosting suspends an account for non-payment, Client shall be allowed to re-instate Client's use of the Services within Five (5) business days of cancellation upon approval from Lis Hosting and full payment of balances due.
If a Client terminates their account, Lis Hosting will disable the server/account the day the client specifies the account is cancelled. Lis Hosting will not maintain an archival copy of the Clients Web site or files. It is the responsibility of the Client to remove any data off the server prior to the date provided in their cancellation notice.
5. TAXES
Client will pay and indemnify and hold Lis Hosting harmless from any and all taxes associated with or arising from Client's use of the Services, including any penalties and interest and any costs associated with the collection or withholding thereof.
6. DISCLAIMER OF WARRANTY
THE SERVICES, THE LIS HOSTING SITE, INCLUDING WITHOUT LIMITATION, ALL PRODUCTS AND SERVICES DISPLAYED OR OFFERED ON THE LIS HOSTING SITE, AND ALL TEXT, GRAPHICS, LINKS AND APPLICATIONS ARE PROVIDED TO CLIENT ON AN 'AS IS' BASIS AND WITHOUT WARRANTY OF ANY KIND. Lis Hosting DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO EACH OF THE FOREGOING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ARISING FROM A COURSE OF DEALING. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, LIS HOSTING SPECIFICALLY DISCLAIMS ANY WARRANTY THAT
(1) THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE;
(2) DEFECTS WILL BE CORRECTED;
(3) THERE ARE NO VIRUSES OR OTHER HARMFUL COMPONENTS;
(4) THE SECURITY METHODS EMPLOYED WILL BE SUFFICIENT.
7. LIMITATION OF LIABILITY
IN NO EVENT SHALL Lis Hosting BE LIABLE FOR DAMAGES RESULTING FROM LOSS OF DATA, PROFITS, USE OF THE LIS HOSTING SITE OR ANY Lis Hosting PRODUCTS OR SERVICES, OR FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THIS AGREEMENT OR IN CONNECTION WITH ANY PRODUCTS OR SERVICES PROVIDED HEREUNDER. IN NO EVENT SHALL Lis Hosting CUMULATIVE LIABILITY EXCEED AN AMOUNT GREATER THAN FIVE HUNDRED DOLLARS ($500 AUD).
8. MISCELLANEOUS
If any of the provisions, or portions thereof, of this Agreement are found to be invalid under any applicable statute or rule of law, then, that provision notwithstanding, this Agreement shall remain in full force and effect and such provision or portion thereof shall be deemed omitted. This Agreement (including the Exhibits, attachments and/or addenda, if any,) represents the entire agreement of the parties with respect of the subject matter hereof and supersedes all prior and/or contemporaneous agreements or understandings, written or oral between the parties with respect to the subject matter hereof. This Agreement and the rights granted and obligations undertaken hereunder may not be transferred, assigned or delegated in any manner by Client, but may be so transferred, assigned or delegated by Lis Hosting. Any waiver or any provision of this Agreement, or a delay by any party in the enforcement of any right hereunder, shall neither be construed as a continuing waiver nor create an expectation of non-enforcement of that or any other provision or right. In any legal proceeding between the parties under this Agreement, the prevailing party shall be entitled to recover its costs, expenses and reasonable attorneys' fees. This Agreement is made under and shall be governed by the laws of the United States of America, except with regard to it’s conflict of law rules. This Agreement and Lis Hosting’s policies are subject to change by Lis Hosting without notice. Continued usage of the Services after a change to this Agreement by Lis Hosting or after a new policy is implemented and posted on the Lis Hosting Site constitutes your acceptance of such change or policy. We encourage you to regularly check the Lis Hosting Site for any changes or additions.
Lis Hosting Privacy Policy
Lis Hosting's policies and procedures for handling customer information have been created with the understanding that Internet technologies are still evolving and that Internet business methods are continuing to evolve to meet the needs and opportunities of the changing technologies. As a result, Lis Hosting's policies and procedures are subject to change.
In the course of serving its customers, Lis Hosting acquires, stores and transmits customer communications and information that customers may regard as private or sensitive. Some of this information - such as the customer's name, address and telephone number - is provided to Lis Hosting by its customers in order to establish service. Other information - such as the customer's account status, choice of services, and customer logs - is created and maintained by Lis Hosting in the normal course of providing service. Lis Hosting also uses cookies, which are small pieces of information that a web site can store in a designated file on a user's computer for various reasons. For example, Lis Hosting uses cookies on the landing pages of products sold online which record the customer information that is required on the order form. This information is then forwarded to an internal sales tracking database within Lis Hosting. In addition, Lis Hosting may store customers' electronic mail and other communications as a necessary incident to the transmission and delivery of those communications.
Data Security
Lis Hosting will protect the confidentiality of its customers' information, account information and personal communications to the fullest extent possible and consistent with the law and the legitimate interests of Lis Hosting, its partners, its employees and other customers of Lis Hosting's services. To protect the loss, misuse, and alteration of information that is collected from customers, Lis Hosting has appropriate physical, electronic, and managerial procedures in place.
How is customer information used?
Lis Hosting may use customer information to provide its customers with system information or information about new or upgraded products. Lis Hosting is the sole owner of any information collected on this site. We will not sell, share, or rent this information to others in any ways.
Disclosure of customer information and communications
Lis Hosting will not otherwise disclose its customers' personal and account information unless Lis Hosting has reason to believe that disclosing such information is necessary to identify, make contact with, or bring legal action against someone who may be causing harm or interfering with the rights or property of Lis Hosting, Lis Hosting's customers, or others, or where Lis Hosting has a good faith belief that the law requires such disclosure.
Lis Hosting also will not, except for reasons stated below, disclose to third parties the contents of any electronic mail or other electronic communications that Lis Hosting stores or transmits for its customers. The circumstances under which Lis Hosting will disclose such electronic customer communications are when:
it is necessary in order to provide service to the customer;
it is necessary to protect the legitimate interests of Lis Hosting and its customers;
it is required to cooperate with interception orders, warrants, or other legal process that Lis Hosting determines in its sole discretion to be valid and enforceable;
it is necessary to provide to a law enforcement agency when the contents are inadvertently obtained by Lis Hosting and appear to pertain to the commission of a crime.
Lis Hosting disclaims any intention to censor, edit or engage in ongoing review or surveillance of communications stored on or transmitted through its facilities by customers or others. Lis Hosting will, however, review, delete or block access to communications that may harm Lis Hosting, its customers or third parties. The grounds on which Lis Hosting may take such action include, but are not limited to, actual or potential violations of Lis Hosting's Acceptable Use Policy.

The Notification of Claimed Infringement must include the following:
Physical or electronic signature of a person authorized to act on behalf of the copyright owner.
Identification of the copyrighted work claimed to have been infringed or a representative list if multiple works are involved.
Identification of the material that is claimed to be infringing that should be removed or access to disabled and information reasonably sufficient to enable the online service provider to locate the material (usually a URL to the relevant page).
Information reasonably sufficient to allow the online service provider to contact the complaining party (address, phone number, e-mail address).
Statement that the complaining party has "a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law."
Statement that the information in the notice is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.
CGI Abuse Policy
Our servers are not your testing platforms. User accounts are on high end, live server responsible for maintaining many accounts. Your server space is being provided to display your finished product to the web - NOT for testing purposes. If you are uploading a script to our server, you acknowledge that you have already tested your script elsewhere and that you know how to install the script.
Any script that the on duty administrator deems to be potentially threatening to the overall performance of our web server will be terminated immediately and your account access will be locked out. When scripts are executed that are potentially harmful to the server in the long term, the offending account will be terminated immediately without a refund of any pre-paid fees. A termination includes the purging of all files.
Please note the following cgi usage policies:
The script must use low system resources. Scripts that consume a large amount of server memory or CPU power will be subject to termination, and/or additional fee.
Each user account may not use more than 1% of system resources at any given time. Scripts may not interact with any server configuration or hardware. Users running scripts that interact with any server configuration or any hardware will be subject to immediate cancellation of the user account without refund.
The script can be used and referenced from any site on the Net (i.e. free counters, etc.) however, scripts must stay within the allowable usage of our system resources. Users using more resources than a single user account is entitled to use will be assessed additional monthly charges.
The script must be executed in a timely fashion. Any script that uses the processor for more than a few milliseconds is subject to removal.
Scripts must be secure. Unnecessarily chmoding scripts to 777 is a policy violation. Placing scripts in a publicly viewable directory (one without an index.html files) is a policy violation.
Any accounts with scripts found in violation of any Lis Hosting policy are subject to future scrutiny of all cgi by our system administrator. If a script is found to be harmful to the system, it will be killed immediately and the account locked until the account owners have been contacted. Any time spent by Lis Hosting stuff to kill a script and/or to lock an account will be billed to the account at a rate of $50.00 per hour. Malicious scripts are subject to immediate account cancellation.
Banned Scripts List:
Due to their use of flat files instead of databases, Lis Hosting does not allow the use any of cgi based message boards including but not limited to:
Ikonboard
UBB
YABB
Use of these boards for large or very active forums, results in system performance degradation, and cannot be allowed in our shared server environment. Lis Hosting suggests using IBForums, VBulletin or phpBB as a more efficient, database-driven alternative to these bulletin boards.
UCE / SPAM Policy
The abuse and misuse of e-mail is a serious problem, and Lis Hosting will not tolerate it.
Definition of UCE (Unsolicited Commercial E-mail), or SPAM:
The bulk UCE, promotional material, or other forms of solicitation sent via e-mail that advertise any IP address belonging to Lis Hosting or any URL (domain) that is hosted by Lis Hosting.
Unsolicited postings to newsgroups advertising any IP or URL hosted by Lis Hosting.
The use of webpages set up on ISPs that allow SPAM-ing (also known as "ghost sites") that directly or indirectly reference customers to domains or IP addresses hosted by Lis Hosting.
Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to facilitate a means to SPAM.
Forging or misrepresenting message headers, whether in whole or in part, to mask the true origin of the message.

Repercussions of SPAM:
Across the Web, it is generally accepted that SPAM is an inconsiderate and improper business practice.
Lis Hosting:
SPAM is not only harmful because of its negative impact on consumer attitudes toward Lis Hosting, but also because it can overload Lis Hosting's network and resources.
Our Providers:
Since it is unsolicited, users who receive SPAM often become angry and send complaints to our upstream providers. This upsets our providers who abhor SPAM for the same reasons that Lis Hosting does - it causes negative consumer attitudes and drains resources. We strive to maintain favorable business relationships in the Web community and obviously will not allow any practice that threatens these relationships.
Punishment For SPAM:
Lis Hosting reserves the right to terminate, without warning, any account that violates this policy. Usage of Lis Hosting services constitutes acceptance and understanding of this policy.
Lis Hosting may, at its option, charge $25.00 per SPAM complaint we receive about our customers. These are non-refundable charges and will be invoiced at the time of complaint notification.
Lis Hosting reserves the right to decide what it considers "SPAM", "UCE", "mail bombing", or "bulk e-mail", and to determine from all of the evidence whether or not the e-mail recipients were from an "opt-in" e-mail list.
Should you choose to e-mail from Lis Hosting servers, especially if you use mailing lists, you must read and adhere to the following guidelines, which are offered as a statement of Internet standards and best current practices for proper mailing list management and preventing e-mail abuse.
Basic Mailing List Management Principles for Preventing Abuse
Mailing lists are an excellent vehicle for distributing focused, targeted information to an interested, receptive audience. Consequently, mailing lists have been used successfully as a highly effective direct marketing tool.
Unfortunately, some marketers misuse mailing lists through a lack of understanding of Internet customs and rules of the forum pertaining to e-mail. Others fail to take adequate precautions to prevent the lists they manage from being used in an abusive manner.
The e-mail addresses of new subscribers must be confirmed or verified before mailings commence. This is usually accomplished by means of an e-mail message sent to the subscriber to which s/he must reply, or containing a URL which s/he must visit, in order to complete the subscription. However it is implemented, a fundamental requirement of all lists is the verification of all new subscriptions.
Mailing list administrators must provide a simple method for subscribers to terminate their subscriptions, and administrators should provide clear and effective instructions for unsubscribing from a mailing list. Mailings from a list must cease promptly once a subscription is terminated.
Mailing list administrators should make an "out of band" procedure (e.g., a means of contact by which messages may be sent for further correspondence via e-mail or telephone) available for those who wish to terminate their mailing list subscriptions but are unable or unwilling to follow standard automated procedures.
Mailing list administrators must ensure that the impact of their mailings on the networks and hosts of others is minimized by proper list management procedures such as pruning of invalid or undeliverable addresses, or taking steps to ensure that mailings do not overwhelm less robust hosts or networks.
Mailing list administrators must take adequate steps to ensure that their lists are not used for abusive purposes. For example, administrators can maintain a "suppression list" of e-mail addresses from which all subscription requests are rejected. Addresses would be added to the suppression list upon request by the parties entitled to use the addresses at issue. The purpose of the suppression list would be to prevent subscription of addresses appearing on the suppression list by unauthorized third parties. Such suppression lists should also give properly authorized domain administrators the option to suppress all mailings to the domains for which they are responsible.
Mailing list administrators must make adequate disclosures about how subscriber addresses will be used, including whether or not addresses are subject to sale or trade with other parties. Once a mailing list is traded or sold, it may no longer be an opt-in mailing list. Therefore, those who are acquiring "opt-in" lists from others must examine the terms and conditions under which the addresses were originally compiled and determine that all recipients have in fact opted-in specifically to the mailing lists to which they are being traded or sold.
Mailing list administrators should make adequate disclosures about the nature of their mailing lists, including the subject matter of the lists and anticipated frequency of messages. A substantive change in either the subject matter or frequency of messages may constitute a new and separate mailing list requiring a separate subscription. List administrators should create a new mailing list when there is a substantive change in either the subject matter or frequency of messages. A notification about the new mailing list may be appropriate on the existing mailing list, but existing subscribers should never be subscribed automatically to the new list. For example, if Company A acquires Company B, and Company B has compiled opt-in mailing lists, Company A should not summarily incorporate Company B's mailing lists into its own.
